Official: Navy SEAL died of apparent suicide

WASHINGTON (AP) ? U.S. military officials are investigating the apparent suicide of a Navy SEAL commander in Afghanistan.

Cmdr. Job W. Price, 42, of Pottstown, Pa., died Saturday of a gunshot wound to the head while supporting stability operations in Uruzgan Province, Afghanistan, a U.S. military official said Monday on condition of anonymity because the death is still under investigation.

The official said Price failed to show up for an appointment and was found when others went to check on him.

Price was from Virginia Beach, Va.-based SEAL Team 4, which is part of the mission to train Afghan local police to stave off the Taliban in remote parts of Afghanistan.

It was not immediately known when Price started his tour of duty in Afghanistan, though he had been in command of the team of 25 to 30 men since June 2011, the official said. He said Price had no immediately known professional or work problems other than the stresses of deployment, which can be tremendous for troops.

"The Naval Special Warfare family is deeply saddened by the loss of our teammate," said Capt. Robert Smith, Commander of Naval Special Warfare Group Two, which manages all Virginia-based Navy SEAL teams. "We extend our condolences, thoughts and prayers to the family, friends, and NSW community during this time of grieving."

"As we mourn the loss and honor the memory of our fallen teammate, those he served with will continue to carry out the mission," Smith added Sunday.

Price is survived by a wife and a daughter.

His body is to be returned to the United States early Tuesday.

LaPierre refuses to back new gun curbs

On NBC?s Meet the Press, National Rifle Association chief Wayne LaPierre on Sunday refused to support new gun control legislation and maintained his support for putting armed guards and police in schools in response to the Dec. 14 school shootings in Newtown, Conn.

?If it?s crazy to call for putting police in and securing our schools to protect our children, then call me crazy,? LaPierre told NBC?s David Gregory.

The Atlantic's Jordan Weissmann has an inside look at the organization that made big news this week.

He added that the United States is now spending $2 billion?to train police officers in Iraq and asked why federal funds could not be spent to train school guards to protect school in the United States.

?I know there?s a media machine in this country that wants to blame guns every time something happens,? he said, but he insisted that an armed guard might have been able to stop Adam Lanza, the killer in Connecticut.

LaPierre said, ?We have no national database of these lunatics? and complained that de-institutionalization of the mentally ill had put too many dangerous people on the American streets. ?These monsters walk the streets,? LaPierre said.

He opposed further curbs on private gun sales and contended that the advocates of stringent restrictions on private gun sales want to put ?every gun sale under the thumb of the federal government.?

Sen. Dianne Feinstein, D-Calif., the author of the 1994 ban on certain types of semiautomatic firearms which expired in 2004, has announced that she will introduce new legislation early next year. Semiautomatic firearms, including semiautomatic weapons sometimes called ?assault weapons,? fire one round per pull of the trigger.

But LaPierre called Feinstein?s bill ?a phony piece of legislation? which he predicted would not become law.

After a week of silence following the massacre at Sandy Hook Elementary School the NRA responded, saying armed guns in schools is the answer. "The only thing that stops a bad guy with a gun is a good guy with a gun," said Wayne LaPierre, NRA's executive vice president. NBC's John Harwood reports.

LaPierre?s appearance on Meet the Press followed the strong reaction over his defiant stand during a Friday press briefing about the NRA?s response to the Dec. 14 school shootings in Newtown, Conn.

Amid a national debate over what security measures school administrators should take to ensure the safety of students, gun-control advocates reacted with disbelief Friday to LaPierre?s call for armed guards in every school and his blaming of Hollywood films, video games, and music for school shootings such as the one in Connecticut.

In an impassioned statement in Washington Friday, LaPierre, the organization's CEO and executive vice president, ridiculed the idea that ?one more gun ban or one more law imposed on peaceful, lawful people will protect us where 20,000 other laws have failed.?

LaPierre said America has left its schoolchildren ?utterly defenseless -- and the monsters and the predators of the world know it and exploit it.?

The NRA is confronting its greatest legislative test in 20 years in the aftermath of the Connecticut shootings, as President Barack Obama and some members of Congress are moving to enact further measures to restrict gun sales and possession, most likely as part of a larger bill that would include increased funding for mental illness detection and treatment.

Obama has tasked Vice President Joe Biden with the job of consulting with members of the Cabinet and outside organizations to come up with legislative proposals by next month.

Her bill would outlaw more than 100 specifically-named firearms as well as certain semiautomatic rifles, handguns and shotguns that can accept a detachable magazine and semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds.

After a week of calls for tighter gun restrictions, the National Rifle Association called for putting more armed security officers in the nation's schools and expressed concerns about violence portrayed in video games, movies and music. NBC's Pete Williams reports.

How firmly the NRA?s allies in Congress will oppose any new legislative initiatives from Obama, Feinstein or others remains an open question.

In a test of the NRA?s legislative influence, the House of Representatives late last year passed the National Right-to-Carry Reciprocity Act, which has not yet been acted on by the Senate.

In the House vote, 229 Republicans and 43 Democrats voted for the NRA-backed bill.

The House bill allows a person with a photo identification card and a valid permit to carry a concealed firearm in one state to carry a concealed handgun in another state in accordance with the restrictions of that second state.

Senate Democrats who have worked with the NRA in the past and who are up for re-election in 2014, such as Sen. Mark Begich of Alaska, will be pivotal in the outcome of any legislative battle in the Senate.

?I get that some want to talk about (regulating guns), but we have a broader issue and we live in a violent society and we need to look at mental health and how to make our schools safer,? Begich said Friday in an interview with the Fairbank Daily News-Miner.

Firefighters ambushed by gunman while responding to house fire

A gunman set a trap and shot and killed two firefighters responding to an early morning blaze in Webster, N.Y., police officials said. Two other firefighters were in serious condition.

"It does appear that it was a trap that was set for first responders, but the cause or reasons we don't have at this time," said Webster Police Chief Gerald Pickering as he described? the scene where shots were fired at West Webster firefighters when they arrived at 5:35 a.m. to battle the blaze along Lake Road. Webster is about 10 miles east of Rochester.

The apparent gunman was found dead at the scene, but it?s unclear if he was killed by? a self-inflicted gunshot or if it was from a weapon from police officers who were chasing him.

The victims were Mike Chiapperini, also a lieutenant and public information officer with the local police department, and Tomasz Kaczowka, Pickering said.

Chiapperini was described by Pickering as a lifelong firefighter who started with the department's explorer program and had about 20 years of experience. Kaczowka was a younger firefighter and was also a 911 dispatcher, he said.

West Webster firefighters Joseph Hofsetter and Theodore Scardino were seriously injured and are at Strong Memorial Hospital with gunshot wounds, a hospital spokeswoman said.? Scardino? has? injuries to his chest and lungs. Hofsetter was injured in the pelvis, the spokeswoman said at a media briefing.

Pickering said that one of the firefighters who survived made his way across a bridge to get to safety. The other three did not make it across, Pickering said. Police arrived and rescued the other three firefighters, but two were fatally shot, Pickering said.

"These are volunteers who get up in the middle of the night to fight fires, they don't expect to be shot and killed," a tearful Pickering said at the press conference.

The morning scene was described as chaotic as police and firefighters dealt with an immense blaze as well as gunshots,? local news station WHAM-TV? reports.

?I?m not aware of anything like this happening in Webster, obviously not a firefighter being fired upon,? Webster Fire Marshal Rob Boutillier told the Democrat & Chronicle.? Pickering described Webster as resort lakeside community that is quiet and usually peaceful.

There at least four houses that have been damaged by the fire along Lake Road, WHAM-TV reported. Firefighters had to leave the scene and stop battling the blazes while police secured the scene. They continue to battle the blaze.

Reports: Rolling Stones guitarist Wood ties knot

(AP) ? Two British newspapers say Rolling Stones guitarist Ronnie Wood has married his fiancee Sally Humphreys at a ceremony at London's Dorchester Hotel.

The Sun and the Daily Mirror carried photographs of the 65-year-old rocker with a pale boutonniere and a dark blue suit, and his 34-year-old bride in a traditional white gown and a clutch of matching white flowers.

The Sun quoted Wood as saying "I'm feeling great" as he and his bride kissed and posed for pictures outside the exclusive hotel in London's upscale Mayfair district.

The newspapers said the guests included singer Rod Stewart and his wife Penny Lancaster as well as ex-Beatle Paul McCartney and his wife Nancy Shevell.

A call and an email to Wood's U.S.-based agent weren't immediately returned Saturday.

Genetic clues to insulin production: Genomic analysis method helps track genetic contributors relevant to diabetes

Dec. 23, 2012 ? In research published online Dec. 23, 2012 in the journal Nature Genetics, scientists have found three new and relatively rare genetic variants that influence insulin production, offering new clues about the genetic factors behind diabetes.

"Studying genetic variants -- even rare ones -- helps us learn how genes affect health and disease," said Karen Mohlke, PhD, one of the study's senior authors and associate professor of genetics at the University of North Carolina School of Medicine. "In this study, we've implicated new genes as playing a role in insulin processing and secretion."

The study is also the first time genetic insights have been reported using exome array genotyping, a new tool that is less costly than genetic sequencing. This analysis allows scientists to quickly screen DNA samples for known variants in specific genes. It is especially helpful for testing variants that are rare.

"The exome array allowed us to test a large number of individuals -- in this case, more than 8,000 people -- very efficiently," said Mohlke. "We expect that this type of analysis will be useful for finding low-frequency variants associated with many complex traits, including obesity or cancer."

The scientists pulled data from a large health study directed by researchers at the University of Eastern Finland. A research team including postdoctoral scientist Jeroen Huyghe at the University of Michigan, Ann Arbor led the statistical analysis, which integrated genetic data and detailed health records for a sample of 8,229 Finnish males.

Diabetes, which affects more than 25 million people in the United States, results from problems with the body's ability to produce or use insulin. Rather than pinpointing one gene behind the disease, scientists believe there are a whole host of genes that interact with health and lifestyle factors to influence a person's chances of getting the disease.

The study revealed that certain variants of three genes -- called TBC1D30, KANK1 and PAM -- are associated with abnormal insulin production or processing, even in people without diabetes. The genes may predispose such individuals to developing the disease.

As a next step, the researchers plan to continue to investigate how these genes may lead to diabetes. They also expect the results will inspire other scientists to use exome analysis to look at the genetic factors behind other complex diseases.

In addition to Mohlke, the study's co-Principal Investigators included Michael Boehnke, PhD, of the University of Michigan, Ann Arbor and Markku Laakso, MD, of the University of Eastern Finland and Kuopio University Hospital.

In the U.S., funding for the research came from the National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK) and the National Human Genome Research Institute (NHGRI), components of the National Institutes of Health.

A National Health Service hospital in Great Britain has paid claims by 38 patients or their families, and has apologized to all of them for the grossly negligent care it provided. The Telegraph headlines:?Hospital apologises to 38 families for appalling care that saw a patient starve to death.?

An NHS hospital has apologised to 38 families after a patient starved to death and it left other dying people screaming in pain.

In one of the worst cases, a man had starvation recorded as the cause of his death after being treated at the hospital for two months. ?

Bereaved relatives had told how vulnerable patients were left to starve when trays were placed out of their reach, while others were left in soaking bedsheets. .. The move will serve to intensify debate on why some nurses and doctors are treating patients without compassion, and will add weight to the warning by Mr Hunt that patients can experience ?coldness, resentment, indifference? and ?even contempt? in NHS hospitals.

He warned that in the worst institutions, a ?normalisation of cruelty? had been fostered. ?

The catalogue of failings uncovered by the mass legal action is one of the worst ever exposed at an NHS hospital.
It included:

? A former nurse whose son told how she died after being left unwashed for 11 weeks, and was put on medication so powerful that she could not speak;

? A 35-year-old father-of-four whose family told how he wasted away because staff did not know how to fit a feeding tube;

? A pensioner who was left screaming in pain when his ribs were broken during a botched attempt to hoist him;

? A man who could not feed himself whose daughter described how he was taunted by nurses who took away his food uneaten;

? A great-grandmother left permanently unable to walk after doctors failed to detect a hip fracture.

The families received an average of around $16,000 apiece. Prince Charles has entered the debate over government health care with an article in the Journal of the Royal Society of Medicine, in which the prince wrote that there is ?an urgent need to restore ?a climate of care and compassion? in the health service.? No surprise there: under government medicine, you get the same ?climate of care and compassion? in hospitals as you do in the post office.

Bells toll for 26 victims of school shooting one week after attack; none for gunman's mother

NEWTOWN, Conn. - The bells of Newtown tolled Friday morning to mark one week after the second-deadliest school shooting in U.S. history, ringing 26 times to remember each child and staff member killed. Nationwide, other churches and communities did the same, and President Barack Obama at the White House observed a moment of silence.

The observances ignored the first victim of 20-year-old gunman Adam Lanza: his mother, Nancy, who was shot in the head four times while she lay in bed.

Her death makes 27 killed.

A private funeral was held Thursday in New Hampshire for Nancy Lanza, according to Donald Briggs, the police chief in the town where her funeral was held. About 25 family members attended.

In Newtown, where makeshift memorials of stuffed animals, angels, candles, flowers and balloons are found throughout town, there is only one noticeable tribute to Nancy Lanza. It's a letter written by a friend and shellacked onto a piece of wood.

"Others now share pain for choices you faced alone; May the blameless among us throw the first stone," it reads in part.

Authorities have said Adam Lanza used the guns his mother kept at their home to carry out the rampage. In a small town where multiple funerals have taken place each day, many are angry at Nancy Lanza for not keeping her guns away from her son.

Others think Nancy Lanza was an innocent victim, one who should be included at memorials.

"It's a loss of life and, yes, her life mattered," said resident Christine Lombardi. "Yes, I do believe she should be included."

The Newtown area held a fourth day of funerals Thursday as mourners laid to rest Catherine Hubbard, Benjamin Wheeler, Jesse Lewis and Allison Wyatt, all 6 years old; and Grace McDonnell, 7.

Services elsewhere were held for teachers Anne Marie Murphy and Lauren Rousseau.

The White House has said President Barack Obama will privately observe Friday morning's moment of silence.

The Obama administration will push to tighten gun laws in response to the shooting, Vice-President Joe Biden said Thursday. Biden, who is overseeing the administration's response to the shooting, said he and Obama are "absolutely committed" to curbing gun violence in the United States.

"Even if we can only save one life, we have to take action," he said.

The basic law won 57 percent of the vote in the first round and is now expected to pass through a second round on Saturday. The opposition camp says the document's failure to win a ringing endorsement shows just how divisive it is.

"No constitution is forced on half of a nation oppressively and forcefully," said Youssef, 48, a leftist member of the opposition Popular Current party.

Islamists, who have won every vote since Mubarak was ousted in February 2011, although by shrinking margins, say the constitution must be passed to complete the transition to democracy and Egypt's laws and codes should be based on Islamic principles to reflect the wishes of a Muslim-majority nation.

For liberal-minded Muslims like Youssef, whose camp has struggled to organise against the disciplined ranks of Islamists, that vision means sidelining the rights of Christians, who make up a tenth of Egypt's 83 million people, women and others who see Egypt as a diverse nation and a cultural leader in the Arab world.

"This constitution is heading to the dustbin of history," said the director whose films sought to highlight the nation's slide into poverty under Mubarak and have annoyed Islamists with plots that tackle taboo issues such as sex.

FIGHT ON ITS HANDS

Rights groups say the constitution does not include enough explicit protection for women's rights and point to vague language, such as references to "national" morals. Liberals fear this means religious conservatives will use it to impose social restrictions that could hurt women, minorities and the arts.

The document has a distinctly Islamist flavor. While the source of legislation remains "the principles" of Islamic sharia as in the old text, a new provision adds further details on what that would mean. Another article says Al-Azhar mosque and university, a seat of Sunni Muslim learning, must be consulted on "matters related to the Islamic sharia".

"Under the shadow of the Brotherhood and extremist groups the future of all Egyptians will no doubt be dark," said Fatma Naoot, 48, a poet and columnist, who often speaks out on women's issues and defends the arts against censorship.

Naoot, a liberal Muslim, refers to some of the radical preachers who are now common faces on television as "strangers" to Egyptians, adding: "But I am confident that Egypt will return to us soon."

Defeating the constitution in the referendum now looks beyond the opposition. Their next battle will be a parliamentary election likely in early 2013. The last parliament, dissolved in June, was dominated by Islamists.

Islamists bore the brunt of Mubarak's repressive police state, but liberals and leftists fared little better. Some groups were co-opted, others were harried and their anti-Mubarak protests were routinely crushed by baton-wielding police.

The Muslim Brotherhood, founded in 1928, can draw on a social support and charity network it built up over eight decades, even as its members were jailed. The opposition have not yet matched that, even if groups like the Popular Current and Mohamed ElBaradei's Constitution Party are expanding their reach.

"The Brotherhood faction and the extremist religious groups, are unfortunately only ruled by a sense of revenge for the 80 years (they spent) visualizing and longing for power," said Naoot.

Like Youssef, she has become a regular guest on fiercely argumentative talk shows, lining up against Islamists. The shows have become nightly battle grounds on Egypt's future.

"A woman in the eyes of those seated on the chair of power now is merely a 'thing' that has no decision or will," she said, pointing to Egypt's ancient history with its women leaders and female goddesses, and mentioning that in more modern times one of the earliest female aviators was Egyptian.

DIVISIONS

"Egypt will move on the right path if people stay strong and united in the face of Brotherhood fascism," she said, using the kind of fierce language that has become more common as the political battle lines have hardened.

Both sides employed fiery terms. In a call for a protest in Alexandria this Friday in response to clashes between Islamists and their opponents last week, a Brotherhood official referred to the "ugly face of secularism with its animosity to Islam."

Islamists also say their actions are not seeking to smother the views of others but claim they reflect majority opinion, in a nation where most women are veiled, although that dress code does not indicate political allegiance.

Divisions, they say, are the normal way of politics.

"The whole world is divided and that does not mean the world will enter into global wars," Brotherhood official Essam el-Erian told Reuters after the first-round vote. "Division in any vote doesn't mean the start of a civil war or chaos."

But the Brotherhood's opponents say a constitution should not drive a wedge through a nation because it is meant to reflect the principles of governance not partisan politics.

They also say support for Mursi and his group may be ebbing away. A referendum on a temporary constitution, a parliamentary vote and a presidential election in the past two years suggest at least some slippage in support for Islamists.

The National Salvation Front, an opposition coalition formed after Mursi expanded his powers on November 22 and then pushed through the constitution, has drawn tens of thousands on to the streets to oppose the referendum, although has not managed it with the regularity of Islamists.

Hassan Nafaa, a liberal activist and political science professor, was among voters who plumped for Mursi in the presidential run-off race in June when the alternative was Ahmed Shafik, an ex-military man and former prime minister under Mubarak. Mursi won with 52 percent of the vote.

But Nafaa said Mursi had turned to his own group and ignored other Egyptians, even members of the opposition who had backed him in his election. He said the president was simply dismissing the opposition as "liberals (who) do not have any real weight among the population".

Obama calls for smaller-scale budget deal with GOP

WASHINGTON (AP) ? President Barack Obama has throttled back his ambitions for a sweeping budget bargain with Republicans. Instead, he's calling for a scaled-back measure sufficient to prevent the government from careening off the "fiscal cliff" in January by extending tax cuts for most taxpayers and forestalling a painful set of agency budget cuts.

In a White House appearance Friday, Obama also called on Congress to extend jobless benefits for the long-term unemployed that would otherwise be cut off for 2 million people at the end of the year.

Obama's announcement was a recognition that chances for a larger agreement before year's end have probably collapsed. It also suggested that any chance for a smaller deal may rest in the Senate, particularly after the collapse of a plan by House Speaker John Boehner, R-Ohio, to permit tax rates to rise on million-dollar-plus incomes.

"In the next few days, I've asked leaders of Congress to work towards a package that prevents a tax hike on middle-class Americans, protects unemployment insurance for 2 million Americans, and lays the groundwork for further work on both growth and deficit reduction," Obama said. "That's an achievable goal. That can get done in 10 days."

Maybe, maybe not. The latest plan faces uncertainty at best in the sharply divided Senate. GOP leader Mitch McConnell of Kentucky, who wields great power even in the minority, called Friday for Senate action on a House bill from the summer extending the full menu of Bush-era tax cuts. He promised that it will take GOP votes for anything to clear the Senate, where 60 votes are required to advance most legislation. Democrats control 53 votes.

Earlier, Boehner said Obama needs to give more ground to reach an agreement and that both he and Obama had indicated in a Monday telephone call that their latest offers represented their bottom lines. "How we get there," he added, "God only knows."

Congress shut down for Christmas and Obama flew to Hawaii with his family for the holidays. But both men indicated they'd be back in Washington, working to beat the fast-approaching Jan. 1 deadline with an agreement between Christmas and New Year's.

Obama announced his plans after talking by phone with Boehner and meeting with Senate Majority Leader Harry Reid, D-Nev., who had previously pinned his hopes on an Obama-Boehner agreement and is wary of dealing with McConnell.

At the White House, Obama projected optimism despite of weeks of failed negotiations. "Call me a hopeless optimist, but I actually still think we can get it done," he said.

Boehner spoke in the morning, describing the increasingly tangled attempts to beat the Jan. 1 deadline and head off the perilous combination of across-the-board tax hikes and deep spending cuts.

"Because of the political divide in the country, because of the divide here in Washington, trying to bridge these differences has been difficult," Boehner said. "If it were easy, I guarantee you this would have been done decades before."

Obama said that in his negotiations with Boehner, he had offered to meet Republicans halfway when it came to taxes and "more than halfway" toward their target for spending cuts.

It's clear, however, that there's great resistance in GOP ranks to forging a bargain with Obama along the lines of a possible agreement that almost seemed at hand just a few days ago: tax hikes at or just over $1 trillion over 10 years, matched by comparable cuts to federal health care programs, Social Security benefits and across federal agency operating budgets.

Obama said he remains committed to working toward a goal of longer-term deficit reduction to reduce chronic trillion-dollar deficits while keeping tax rates in place for nearly everyone.

"Even though Democrats and Republicans are arguing about whether those rates should go up for the wealthiest individuals, all of us ? every single one of us ? agrees that tax rates shouldn't go up for the other 98 percent of Americans," Obama said, citing statistics associated with his promise to protect household income under $250,000 from higher tax rates.

Neither the House nor the Senate is expected to meet again until after Christmas. Officials in both parties said there was still time to prevent the changes from kicking in with the new year.

The week began amid optimism that Obama and Boehner had finally begun to significantly narrow their differences. Both were offering a cut in taxes for most Americans, an increase for a relative few, and cuts of roughly $1 trillion in spending over a year. Also included was a provision to scale back future cost-of-living increases for Social Security recipients ? a concession by the president that inflamed many liberals..

GOP officials said some senior Republicans such as Rep. Paul Ryan, R-Wis., the most recent Republican vice presidential nominee, opposed the possible agreement. But No. 2 House Republican Eric Cantor of Virginia has joined arms with Boehner.

Boehner stepped back and announced what he called Plan B, legislation to let tax rates rise on incomes of $1 million or more while preventing increases for all other taxpayers.

Despite statements of confidence, he and his lieutenants decided late Thursday they were not going to be able to secure the votes needed to pass the measure in the face of opposition from conservatives unwilling to violate decades-old party orthodoxy never to raise tax rates.

The retreat came after it became clear that too many Republicans feared "the perception that somebody might accuse them of raising taxes," Boehner said.

Boehner also said that last Monday he had told Obama he had submitted his bottom-line proposal.

"The president told me that his numbers ? the $1.3 trillion in new revenues, $850 billion in spending cuts ? was his bottom line, that he couldn't go any further."

That contradicted remarks by White House press secretary Jay Carney, who said on Thursday that Obama has "never said either in private or in public that this was his final offer. He understands that to reach a deal it would require some further negotiation. There is not much further he could go."

Google Updates Mod_Pagespeed With Smarter Caching, Progressive JPEGs

page_speedGoogle wants the web to be as fast as possible and it's been working on a number of initiatives like SPDY, PageSpeed Tools, its hosted libraries and, of course, its Chrome browser. One tools that doesn't get quite as much press as projects like Chrome and SPDY is mod_pagespeed for the open-source Apache web server. Mod_pagespeed automatically implements a number of performance optimizations techniques that can help improve the loading times of the sites that implement it. Google has now launched version 1.2 of mod_pagespeed. This new version focuses on four features: improved caching for JavaScript libraries like jQuery and jQuery UI, pre-resolving DNS requests, the ability to proxy and optimize resources from trusted domains and core support for transcoding JPEG images to progressive.

Tough Times for Trolls and their "Copyright Negligence" Scheme ...

Despite at least five smackdowns by federal judges, copyright trolls are still accusing Internet subscribers of "negligently" allowing someone else to download porn films without paying. Last week, subpoena defense attorney Morgan Pietz fought back by asking the Northern California federal courts to put all of the open "negligence" cases filed by a prolific troll firm in front of a single judge - a judge who already ruled that the "negligence" theory is bogus.

In August 2011, we said "there is no negligence theory of copyright liability. Zip, none, nada."? In 2012, at least six federal judges in California, New York, and Hawaii agreed with us, throwing out or blocking cases based on this theory. Not a single judge that we know of has let the "copyright negligence" or "wifi negligence" theory go forward when a defendant has challenged it. Copyright law provides ways to go after people who contribute to infringement in a substantial way - something far more than sharing an Internet subscription with a housemate or running an open Wi-Fi router. Helping others to access the Internet is something that the law favors and protects. No law forces Internet providers, large or small, to be copyright cops. At least six judges have confirmed that using state personal injury law to bypass those protections is simply a non-starter.

Yet at least one attorney - Brett Gibbs, an affiliate of the Prenda Law Firm - is still trying to use "negligence" accusations to coerce settlements from Internet subscribers. Mr. Gibbs still has about 30 open cases in Northern California alone, assigned to numerous judges, where he is seeking damages based on the very same, thoroughly discredited "negligence" theory. It's likely that Prenda is using the threat of these suits to demand settlements of $2,000-$5,000 from Internet subscribers, without evidence that the subscribers themselves downloaded anything. Needless to say, using a false legal theory as leverage for settlement demands is despicable.

Given this situation, we're happy that subpoena defense attorney Morgan Pietz has filed a motion to bring all of the "copyright negligence" cases in Northern California together in front of Judge Phyllis Hamilton, who already dismissed one such claim. Pietz pointed out that all of the cases are practically identical - only the IP addresses and names of the defendants are different.

Enhancing the efforts of Mr. Pietz and other subpoena defense attorneys, EFF is working to inform judges and ISPs about the farcical "copyright negligence" suits and other troll tactics. The fight to protect Internet users against shakedowns will go on, and we're hopeful that this tactic will soon be history.

Also, those stats about how graphics are liked better than plain text posts are conveniently not mentioning that a whole lot of those text posts are teenagers complaining about school, their parents, each other... It would be a relevant statistic only if FB takes the *content* into consideration. Sure, pictures/graphics will generate more likes, because people don't usually bother to make a graphic that says "the lunch lady was so rude to me today", where they do enjoy seeing bumper stickeresque sayings and share those around.?

In the 80s we bought buttons with cutesy sayings and wore them around for a while. In this decade, the FB "graphics" are the equivalent. That doesn't make it good for marketing.?

On the other hand, people do like pictures of stuff I make and of the staff here, and especially illustrations to go along with blog posts. Actual photography, in other words, not just words in a box with a cute border. It helps them connect with us and get a running leap on what to expect from our store.?

Pictures are important for businesses because a lot of people have that social shyness thing, a slight fear of going into a new place. Bringing it to them even on a virtual level can help them feel a lot more comfortable with the idea of stopping by.

Infographics are creative constructs that too often are more arty than communicative. What exactly is this infographic telling us? It isn't telling us that we're communicating more effectively with pictures and videos - only that we are using more graphics and video. ?

The fact is, picture can create more questions and confusion than clarity. And viewing videos can consume far more time than reading copy. ?

The key point I want to make here is really a warning: Visual doesn't necessarily mean clearer communications. As marketers have known for years, to communicate effectively you need to SIMPLIFY rather than complicate your message. In my opinion, most infographics - including this one - complicate rather than simplify. ?

Sandy McCulloch, Oregon Man, Is Looking For A Wife With This Sign

Recently people have used signs to punish their wayward children on Facebook or on street corners. But Sandy McCulloch has an entirely different purpose in mind for the sign he wears around his neck. He wants to find a wife.

That's right, the 82-year-old bachelor from Corvallis, Oregon has taken to wearing a handmade sign around his neck to find his next Missus, the Associated Press reports. The sign reads, "Wanted: A Wife," followed by handwritten requirements: the future Mrs. McCulloch must be over 60, live in the same town, love books and have a great sense of humor.

McCulloch told the AP his sign is serious. ?People look for a wife for different reasons when they are 20 or 25 than when they are my age,? McCulloch said. ?I?m looking for companionship.?

The writer -- who was divorced three times before 40 -- got the idea from a hospital greeter he met while waiting for a friend who worked at the hospital. After the greeter checked on McCulloch three times to ask if he needed any help, he responded, ?There is one piece of assistance you can give me. I need a wife.?

While the greeter wasn't "The One," she did give him an idea: wear a sign advertising that he's looking since the hospital is full of single women. McCulloch ran with the idea a week later after a second hospital greeter agreed it could work.

McCulloch and his sign made their debut at a local fair, where he got tons of approval from the crowd. He even met a woman, and spoke to her for an hour. But she didn't meet his age requirement so they've only remained friends.

?The response was rather amazing and delightful,? he said. ?It?s the closest I?ve ever come to being a rock star in a room full of people.?

McCulloch is quite the catch -- the published author has led an interesting life full of literature and travel. He plans on wearing the sign at his town's local fair, library, the hospital lobby and Starbucks for good measure.

?In all honesty, I don?t know if this will lead to anything," McCulloch told the AP. "If nothing else, it has been a lot of fun.?
